Please read these terms and conditions carefully before ordering any Products from our site.

This page, and any documents referred to within it, covers our terms and conditions. These terms and conditions govern how we supply any of the products (Products) listed on our website freshflower.co.uk (our site) to you, our customer.

By ordering any of our Products, you agree to be bound by these terms and conditions. You may wish to print a copy of them for future reference.

freshflower.co.uk is operated by the Fresh Flower Company (London) Ltd. The Fresh Flower Company is registered in England and Wales under company number 4537810. The registered office is 39a North Cross Road, East Dulwich London Se22 0PQ and our VAT (value added tax) number is 691 1880 16.

Intellectual property rights

The Fresh Flower Company owns all intellectual property rights concerning this website including design, text, graphics, logos, images and other materials. It is illegal to reproduce, copy, use, sell or duplicate content and trademarks from this website without prior written consent.

Access to our site

The Fresh Flower Company reserves the right to withdraw or amend our website at any time.

Where the Fresh Flower Company has provided you with a user ID, password or other security measures this information must be treated as confidential and you may not disclose it to any third party.

By using our site you agree to accept and abide by all of our terms and conditions and act according to the law.

You may not alter, impair or interfere in any way with our website. If you default negligently in any obligations set out in these Terms and Conditions – including our Privacy Policy – you shall be liable for all the losses and damages that this may cause to the Fresh Flower Company.

By placing an order through our site, you guarantee that:

  • you are legally entitled to enter into binding contracts
  • you are at least 18 years old.

Ordering online

After placing an order, you will be sent a confirmation e-mail. This will give details of your transaction, including:

  • your order number
  • the price paid for your order
  • the price paid for delivery
  • the total that has been debited from your credit or debit card.

Our status

Our site contains links to the websites of other companies and organisations. The Fresh Flower Company is not responsible for content on these external websites, nor for the quality of products and services purchased from them.

Prices

All prices quoted on our website include value added tax (VAT) at current rates and exclude delivery.

We reserve the right to change our prices at any time and will update the website accordingly.

Payment

You may make payments with a debit or credit card. All cards are subject to validation checks and authorisation by the card issuer. The Fresh Flower Company is not be liable for delays or non-delivery if a customer’s card issuer refuses to authorise payment.

Ownership of the Products will only pass to customers once full payment of all sums due in respect of the Products, including delivery charges, has been received by the Fresh Flower Company.

Delivery

We will send out Products according to the option selected. Because we only use the freshest flowers, appropriate substitutions may be made when the flowers or foliage shown in photographs are out of season or unavailable.
We send our goods out by courier on a ‘signature optional delivery’. This means that if nobody is at home to receive the flowers, they may be left on the property (for example, in a porch or on a step), or with a neighbour.

If there is a better place to leave the flowers on the property please specify this when prompted to do so in the checkout area of our site. If you do not wish flowers to be left if no one is home then please write this in the comments box in the checkout area. In this case, the flowers will be taken back to the delivery depot and the recipient will be left a card asking them to call to arrange redelivery.

All products will be at your risk from the time of delivery.

If a delivery is delayed by a third party, by fire, flood or mechanical breakdown the Fresh Flower Company cannot accept liability.

If orders are wrongly delivered because the incorrect information has been supplied, for example, the postcode or house name, then the Fresh Flower Company cannot accept liability.

Refunds policy

Fresh Flower Company bouquets are guarantees for five days from delivery provided that the care instructions are followed.

The Fresh Flower Company endeavours to dispatch all flowers in perfect condition. It is unlikely that your flowers will be damaged in transit. But if they are, please keep them and contact the Fresh Flower Company within 24 hours of receiving them. The Fresh Flower Company cannot be liable for claims reported after 24 hours of receipt.

Where possible the Fresh Flower Company will replace damaged flowers. However if this is not possible a full refund will be offered to the purchaser.

Our right to change these terms and conditions

The Fresh Flower Company reserves the right to change these terms and conditions from time to time and as it sees fit.

Customers are subject to the policies, terms and conditions in force at the time that they order products from the Fresh Flower Company, unless the law of a governmental authority requires changes to these policies, terms and conditions.

Law and jurisdiction

Contracts for the purchase of Products on our website are governed by English law. If a dispute arises from, or relates to, such Contracts, then it will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
